Under the annulment procedure, the Welsh Ministers make the statutory instrument then lay it before the Senedd. The Senedd then has a period of 40 days to annul the statutory instrument. If the instrument is not annulled, then it continues to have effect. If the statutory instrument is annulled by the Senedd, it ceases to be law.
Most Welsh statutory instruments follow this procedure.
If a statutory instrument subject to the annulment procedure made by the Welsh Ministers is not laid before the Senedd at least 21-days before the statutory instrument comes into force (i.e. has effect), the Welsh Government must notify the Presiding Officer and explain why. This is known as the "21-day rule". Statutory instruments that breach the 21 day rule are listed separately.
