Some subordinate legislation, such as Commencement Orders, is not subject to any formal procedure other than it must be laid before the Senedd. The “responsible committee” can exercise its discretion as to whether it carries out scrutiny of such subordinate legislation.
As of 1 January 2026, every Welsh statutory instrument must be laid before the Senedd, even those that are not subject to any procedure. If this is not done before the instrument comes into force, a letter of explanation as to why must be provided to the Llywydd under section 37F(4) of the Legislation (Wales) Act 2019.
