To propose that the National Assembly for Wales in accordance with Standing Order 22.34:

Approves the draft The National Assembly for Wales (Legislative Competence) (Environment) Order 2010.

The draft Order and Explanatory Memorandum were laid before the Assembly on 24 November  2009.

The report of the Proposed Environmental Protection and Waste Management LCO Committee was laid before the Assembly on 29 November 2007.

The report of the Legislation Committee No. 4 on the Proposed National Assembly for Wales (Legislative Competence) (Environment) Order 2009 was laid before the Assembly on 19 June 2009

NDM4336 Carwyn Jones (Bridgend)

To propose that the National Assembly for Wales:

1. Welcomes the 2008-09 Annual Review of the Children’s Commissioner for Wales; and

2. Notes that the Minister for Children, Education, Lifelong Learning and Skills will draw up a response from the Welsh Assembly Government and report to the National Assembly on this by 31 March 2010.

To propose that the Assembly resolves to adopt the following amendments to motions:

Insert new point at the end of the motion:

'Regrets the lack of clarity as to where the boundaries of the National Assembly's Legislative Competence will lie.’

Insert new point at the end of the motion:

'Regrets the extensive use of carve-outs and notes that the carve-outs add complexity and a of lack of clarity to the legislation.
