Item 2: The National Assembly for Wales (Diversion of Functions) (No 2) Order 2007

NDM3637 Jane Hutt (Vale of Glamorgan) To propose that the National Assembly for Wales: Resolves that a recommendation should be made to Her Majesty in Council to make the National Assembly for Wales (Diversion of Functions) (No 2) Order 2007  made under paragraph 31(1)(a)(ii) of Schedule 11 to the Government of Wales Act 2006. The draft Order was laid in Table Office, under Standing Order 29.2, on 27 June 2007. The Motion was agreed, in accordance with Standing Order 7.35.

Motion to suspend Standing Orders

NNDM3647 Dafydd Elis-Thomas (Dwyfor Meirionnydd) That the National Assembly for Wales in accordance with Standing Orders 35.6 and 35.8: Suspends Standing Order 7.18 (i) and that part of Standing Order 6.10 that requires the weekly announcement under Standing Order 6.3 to constitute the timetable for business in Plenary for the following week, to allow the motions under Item 3 to be considered in Plenary on Wednesday 4 July 2007. The Motion was agreed, in accordance with Standing Order 7.35.

Item 3: Motions to establish and elect Committees on Legislation

NNDM3641 Dafydd Elis-Thomas (Dwyfor Meirionnydd) To propose that the National Assembly for Wales, in accordance with Standing Order 21.1, establishes a Committee to consider and report on the proposed ’National Assembly for Wales (Legislative Competence) (No. 2) Order 2007’ in relation to Environmental Protection and Waste Management. The Committee shall cease to exist once the related draft Order has been introduced under Standing Order 22.31.   NNDM3642 Dafydd Elis-Thomas (Dwyfor Meirionnydd) To propose that the National Assembly for Wales, in accordance with Standing Order 10.3, elects Jane Davidson, Lorraine Barrett, Alun Ffred Jones, Darren Millar and Mick Bates as members of the Proposed Environmental Protection and Waste Management LCO Committee. NNDM3643 Dafydd Elis-Thomas (Dwyfor Meirionnydd) To propose that the National Assembly for Wales, in accordance with Standing Orders 21.1, establishes a Committee to consider and report on the proposed 'National Assembly for Wales (Legislative Competence) Order 2007’ in relation to Additional Learning Needs. The Committee shall cease to exist once the related draft Order has been introduced under Standing Order 22.31.   NNDM3644 Dafydd Elis-Thomas (Dwyfor Meirionnydd) To propose that the National Assembly for Wales, in accordance with Standing Order 10.3, elects Carwyn Jones, Jeff Cuthbert, Janet Ryder, Alun Cairns and Eleanor Burnham as members of the Proposed Additional Learning Needs LCO Committee. NNDM3645 Dafydd Elis-Thomas (Dwyfor Meirionnydd) To propose that the National Assembly for Wales, in accordance with Standing Orders 21.1, establishes a Committee to consider and report on the proposed 'National Assembly for Wales (Legislative Competence) (No. 3) Order 2007’ in relation to Vulnerable Children. The Committee shall cease to exist once the related draft Order has been introduced under Standing Order 22.31.   NNDM3646 Dafydd Elis-Thomas (Dwyfor Meirionnydd) To propose that the National Assembly for Wales, in accordance with Standing Order 10.3, elects Gwenda Thomas, Karen Sinclair, Nerys Evans, David Melding and Kirsty Williams as members of the Proposed Vulnerable Children LCO Committee. NNDM3647 Dafydd Elis-Thomas (Dwyfor Meirionnydd) To propose that the National Assembly for Wales, in accordance with Standing Orders 21.1, establishes a Committee to consider and report on the general principles of the Proposed NHS Redress (Wales) Measure 2007. The Committee shall cease to exist if the proposed Measure is passed, falls or is withdrawn, or a new committee is set up to consider Stage 2 proceedings under Standing Order 23.31(ii). NNDM3648 Dafydd Elis-Thomas (Dwyfor Meirionnydd) To propose that the National Assembly for Wales, in accordance with Standing Order 10.3, elects Edwina Hart, Val Lloyd, Helen Mary Jones, Jonathan Morgan and Jenny Randerson as members of the Proposed NHS Redress (Wales) Measure Committee. The Motions were agreed, in accordance with Standing Order 7.35.

Item 4: Plaid Cymru Debate

NDM3638 Jocelyn Davies (South Wales East)
To propose that the National Assembly for Wales:
1. Calls on the UK Government to reconsider its centralisation of public service offices in light of their adverse economic, social and environmental impact; and 2. Calls on the Welsh Assembly Government to collaborate with the UK government in order to share locations in the provision of services. Amendment - William Graham (South Wales East) - Not moved Add as new point at end of Motion: "Calls on the Welsh Assembly Government to oppose the anticipated closure of HM Revenue & Customs Offices in Wales.” The Motion was agreed, in accordance with Standing Order 7.35.

Item 5: Welsh Conservatives Debate  

NDM3639 William Graham (South Wales East) To propose that the National Assembly for Wales: 1. Welcomes the commitment of the Welsh Assembly Government to provide for an effective and universal system of advocacy services for children and young people in Wales; 2. Notes the publication of the consultation document on a 'New Service Model for Delivering Advocacy Services for Children and Young People'; and 3. Calls on the Welsh Assembly Government to: a) Acknowledge the need for robust and transparent independence in the commissioning of advocacy services for children and young people; b) Accept that providers of public services are not best placed to commission independent advocacy to support children and young people who wish to complain about the delivery of public services; c) Create an independent all-Wales commissioning body for the provision of advocacy services for children and young people; and d) Acknowledge the widespread support for an independent commissioning process for advocacy services, among organisations promoting the welfare of children and young people. The following amendments were tabled:
Amendment 1 - Jocelyn Davies (South Wales East) Insert as new point 2, and re-number accordingly: "Notes with concern the delay in the development of the advocacy, complaints, and whistle blowing procedures repeatedly recommended by the office of the Children’s Commissioner.” Amendment 2 - Jane Hutt (Vale of Glamorgan) Delete point 3 and replace with: "Looks forward to the results of the consultation exercise, due for completion on 23 July 2007.” Amendment 3 - Jocelyn Davies (South Wales East) Delete Point 3.c) and replace with: "Make provision for the commissioning of advocacy services for children and young people to be the responsibility of an all-Wales independent body; and” Amendment 4 - Jocelyn Davies (South Wales East) Insert as new point 3.d), and re-number accordingly: "Begin the process of improving the availability of advocacy services by prioritising access for looked after children; and”
