The National Assembly for Wales:

Notes the report of the Health, Wellbeing and Local Government Committee on its Inquiry into the Children and Family Court Advisory & Support Service (CAFCASS) Cymru, which was laid in the Table Office on 14 July 2009.

Note: The response by the Deputy Minister for Social Services to the report was laid on 19 October 2009.

To propose that the National Assembly for Wales in accordance with Standing Order 22.34:

Approves the draft The National Assembly for Wales (Legislative Competence) (Health and Health Services and Social Welfare) Order 2010.  

The draft Order and Explanatory Memorandum were laid before the Assembly on 2 December 2009;

The report of the Mental Health Services LCO Committee on the proposed The National Assembly for Wales (Legislative Competence) (No. 6) Order 2008 was laid before the Assembly on 20 June 2008.

The National Assembly for Wales:

1. Expresses concern that the Flood and Water Management Bill will not provide clarity of responsibility over flood protection & prevention.

2. Recognises the importance of adopting a single lead agency approach to flood protection, prevention and response  

3. Expresses concern over the consequence some planning decisions can have on increasing flood risk and calls upon the Welsh Assembly Government to urgently review TAN 15.

4. Calls on the Welsh Assembly Government to implement the recommendations of the Wales Audit Office's report on Coastal Erosion and Tidal Flooding Risks in Wales.

To propose that the National Assembly for Wales, in accordance with Standing Order 22.50, agrees that Darren Millar may lay a proposed Order, to give effect to the outline proposed Order provided on 5 June 2008 under Standing Order 22.48, and an Explanatory Memorandum.

To propose that the Assembly resolve to adopt the following amendments to motions:

Delete all and replace with:

The National Assembly for Wales:

  1. welcomes the publication of the Flood and Water Management Bill which confers powers and responsibilities to Ministers in Wales;

  2. recognises that this will enable more effective, strategic and comprehensive management of flood risk in Wales and better protection for people who live in areas at risk of flooding from any source;

  3. welcomes the success of Tan 15 in preventing inappropriate development in areas at risk of flooding; and

  4. commends the work done by the emergency services, local authorities, the Environment Agency, third sector organisations and communities in responding to recent flooding incidents and the effective partnerships that have developed.
